Copyrighted Material – HEOA Section 493 HEA Section 487(a)(29)

Requirement:

Certify to the Secretary of Education that the institution:

  • Has developed plans to effectively combat the unauthorized distribution of copyrighted material, including through the use of a variety of technology-based deterrents.

  • Will, to the extent practicable, offer alternatives to illegal downloading or peer-to-peer distribution of intellectual property, as determined by the institution in consultation with the chief technology officer.

CCS Response:

Our acceptable use policy says “CCS IT Resources may not be used to violate or circumvent U.S. Copyright laws”. (Board Policy 7.30.05 and 7.50.20)

All students and employees accept the policy the first time they use a CCS IT resource each quarter.

CCS Library Services offers students, faculty, and staff alternatives to illegal downloading of intellectual property in the form of subscription services and licensed e-materials, including periodical articles, reference materials, e-books, and streaming video. The library also provides help in acquiring the appropriate licensing for those who wish to show/view films, documentaries, etc. outside the classroom environment.

SCC Response:

Community Colleges of Spokane, including Spokane Community College, uses a traffic shaper to de-prioritize and limit usage of Peer-2-Peer (P2P) applications on campus networks. This includes networks where CCS owned employee and lab computers are located. There is not an outright block on P2P networking for those devices. The guest networks and networks that have student owned devices use an Intrusion Detection System (IDS) system built into the firewall to actively block P2P applications.

SCC’s last Digital Millennium Copyright Act (DMCA) Takedown Notice was received on May 1, 2017 on the Guest Network.  This request prompted the installation of the IDS system to block P2P access. A previous Digital Millennium Copyright Act (DMCA) Takedown Notice was received by SCC on July 16, 2016.
